Discussion of several petitions on fundamental rights and child protection in Denmark and Netherlands
Petition 0943/2012 by Jelena Antonova (Latvian), on discrimination and alleged violation of free movement of persons The petitioner is a Latvian citizen living permanently in the Netherlands. The Dutch Youth Care Office has removed her parental authority over her two underage children and placed them in a relief centre. According to the petitioner, one of the reasons given for this decision was that she could only speak Russian. However, the petitioner can prove that she speaks Dutch within the framework of her integration course. The petitioner believes that the Dutch authorities discriminate against her on the basis of her language and that the fact that she speaks Russian with her children is irrelevant for the execution of her parental duties. The petitioner also complains that her children are not allowed to speak Russian to each other at the relief centre, even though this is their mother tongue. She believes that this also represents discrimination and is in violation of the Treaty and other European legislation. She requests an investigation. Recommendations
– Declare admissible;
– ask the Commission for information;
– ask the Dutch authorities for information.
